1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Local Sites Online ("Company," "we," "our," or "us") regarding your use of our website, services, and products. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Description of Services
Local Sites Online provides web design, local SEO, and digital marketing services specifically for local service businesses. Our services include but are not limited to:
- Website design and development
- Google Business Profile setup and optimization
- Local search engine optimization (SEO)
- Content creation and blog management
- Review management and automation
- Lead generation and funnel setup
- CRM and marketing integrations
- Ongoing support and maintenance
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.
4. Service Packages
Package Options
We offer three main service packages:
- Local Launch: Basic website and Google Business Profile setup
- Local Boost: Multi-page website with enhanced SEO and content
- Local Domination: Complete automation and advanced integrations
Payment Terms
All packages are offered as one-time payments unless otherwise specified. Payment is due in full before work begins. We accept major credit cards and bank transfers. Prices are subject to change with 30 days' notice for new customers.
Refund Policy
We offer a 30-day satisfaction guarantee from the date of project completion. If you are not satisfied, we will work with you to resolve any issues or provide a partial refund based on work completed. Please note that refunds do not cover non-recoverable third-party costs such as domain registration, hosting, or software subscriptions purchased on your behalf. Ongoing monthly services will end at the close of the paid billing cycle.
5. Project Timeline and Delivery
Typical project timelines are:
- Local Launch: 3-7 business days
- Local Boost: 7-14 business days
- Local Domination: 28+ business days
Timelines may vary based on project complexity and client responsiveness. We will provide regular updates on project progress and notify you of any delays.
6. Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide accurate and complete information about their business
- Supply necessary content, images, and materials in a timely manner
- Respond to requests for feedback and approval within 48-72 hours
- Provide access to necessary accounts (Google, hosting, domain, etc.)
- Review and approve work at designated milestones
- Comply with all applicable laws and regulations
- Not use our services for illegal or harmful purposes
7. Intellectual Property Rights
Client Content
You retain ownership of all content, materials, and intellectual property you provide to us. You grant us a limited license to use this content solely for the purpose of providing our services.
Deliverables
Upon full payment, you will own the website design, custom content created for your project, and related deliverables. We retain ownership of our proprietary tools, methodologies, and general knowledge.
Third-Party Assets
Some projects may include third-party plugins, themes, or assets subject to their own licensing terms. We will identify any such assets and ensure proper licensing.
8. Hosting and Domain Services
Most packages include one year of hosting and domain registration. After the first year:
- You are responsible for ongoing hosting and domain renewal fees
- We can continue to manage hosting for an additional fee
- You may transfer your website to your own hosting provider
- We will provide necessary files and assistance for transfers
Local Domination package clients have the option for full website ownership and hosting flexibility from the start.
9. Support and Maintenance
Support periods vary by package:
- Local Launch: 14 days post-launch support
- Local Boost: 30 days post-launch support
- Local Domination: 60 days priority support
Support includes bug fixes, minor content updates, and technical assistance. Major changes or additions may require additional fees. Extended support plans are available.
10. Limitation of Liability
To the maximum extent permitted by law, Local Sites Online shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to our services, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Website downtime or technical issues
- Search engine ranking changes
- We do not guarantee specific rankings, traffic increases, or lead generation results. Outcomes may vary based on many factors outside our control
- Third-party service interruptions
- Data loss or security breaches
Our total liability shall not exceed the amount paid for our services. We do not guarantee specific results, rankings, or lead generation outcomes.
11. Indemnification
You agree to indemnify and hold harmless Local Sites Online from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate services with written notice. In case of termination:
- Completed work will be delivered upon payment of outstanding fees
- Work in progress will be billed on a time and materials basis
- Refunds will be calculated based on work completed
- We reserve the right to retain a reasonable termination fee
We may terminate services immediately for breach of Terms, non-payment, or illegal activities.
13. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our privacy practices as described in our Privacy Policy.
14. Dispute Resolution
We encourage resolution of disputes through direct communication. If a dispute cannot be resolved informally:
- Disputes will be resolved through binding arbitration
- Arbitration will be conducted under the rules of the American Arbitration Association
- Arbitration will take place in Indiana
- Each party will bear their own costs and attorney fees
You waive any right to participate in class action lawsuits or class-wide arbitration.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Indiana, without regard to conflict of law principles. Any legal action must be brought in the appropriate courts of Indiana.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use of our services after changes indicates acceptance of new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with enforceable provisions that achieve the same intent.
